Welcome to our Tash Matash platform. To foster a secure and positive environment for all users, we have implemented this anti-spam policy to clearly outline acceptable use and prevent unwanted and intrusive activities.

This policy is applicable to all Build Yours Business Services that may be used for transmitting bulk emails or commercial emails (“Covered Services”). You agree to Build Yours Business Anti-Spam Policy as a precondition to use of Covered Services. Covered Services may be used only for sending mails or messages to persons from whom you have an express permission to send mails or messages on the subject of such mail or message, such as permission-based email marketing. We are very serious about our Anti-Spam Policy. If we discover that you are sending emails or messages to people without their permission, we reserve the right to terminate your user account.

The rule of thumb is “Do not use Covered Services to send mails or messages to email addresses to which you do not have express permission to send emails on the subject of the email.” We insist on 100% compliance with the above rule. When we say 100%, we do not include those instances where the recipient of an email has marked it as Spam although you have an express provable permission to send emails to that email address. It should be borne in mind that a permission once granted is deemed to have been revoked if the recipient of a mail has opted out of receiving emails from you. In particular, you shall strictly comply with the following rules, which clarify the Rule of Thumb mentioned above: You should have explicit permission to contact the recipient on the subject of your email. You shall maintain sufficient proof of the fact that you have received permission from all recipients of emails sent by you through Covered Services. You shall not import or send emails to email addresses that you have bought, loaned, rented or in any way acquired from a third party, irrespective of any claim about quality or permission, while using Covered Services. You shall also refrain from importing into your Covered Services account or sending mails to email addresses you have collected from other websites.

By “permission” we mean express and provable permission granted to you. A permission to send commercial emails may be through:

  •  Submission of email address as part of downloading anything from your website or ordering a product or service from you.
  •  Subscription to an email newsletter by filling a form on your website.
  •  Someone has provided you with the email address as part of participation in any contest, event or survey conducted by you and you have informed him/her that you would be sending them marketing emails.
  •  Any instance where a person completing a form has checked an opt-in checkbox indicating their willingness to be contacted by you through email, provided the checkbox is unchecked by default and you have informed such person that the nature of the emails will be commercial.
  •  Any business card given by a person who has expressed his/her willingness to receive emails of a commercial nature. Willingness to receive emails of a commercial nature will be presumed where the business card was dropped in your booth at a tradeshow.
  •  You shall ensure that the routing and header information including your emails “From” and “To,” the originating domain name and email address are true and accurate.
  •  You shall not use subject lines that mislead the recipient about the contents or subject matter of the message.
  •  You shall provide a one-click unsubscribe option in all emails and refrain from sending emails to persons who have opted out or un-subscribed from your mailing list. The request to opt-out from the mailing list should be honored within 10 days from the date of request.
  •  You shall include your valid physical postal address in all emails sent through Covered Services.
  •  You shall include a conspicuous notice in all marketing emails that the message is an advertisement or solicitation and that the recipient can opt out of receiving more commercial emails from you. We may, at any time, require you to prove that you have express permission to send emails to email addresses you have imported to your Covered Services irrespective of whether you have sent marketing emails to such email addresses. Your use of Covered Services signifies your unconditional acceptance of this Anti-Spam Policy. Message Recipient Policy

Before clients can receive Build Yours Business‘s messages, advertising or promotions, client must have agreed to receive such messages. Any recipient may request at any time to be removed from our list, and we will comply with that request. In addition, we will thoroughly investigate any allegations made by recipients relating to unsolicited messages.

Policy against advertising our website using unsolicited email messages

We require that all e-mails promoting Build Yours Business or its products are sent only to clients who have agreed to receive such messages. We prohibit any advertising of our brand and Web site using unsolicited email messages. Not complying with this policy will cause partnership termination and/or affiliate account termination.

If you feel you’ve been sent unsolicited emails promoting our brand or website and would like to register a complaint. We will immediately investigate all allegations made related to unsolicited messages.

  •  Your email address is safe with us.
  •  We never sell or share your email addresses with other companies.
  •  You can un-subscribe at any time.

We require that each e-mail message sent out from Build Yours Business includes an easy way for subscribers to remove themselves via an un-subscribe link.

If you receive a newsletter or email and decide you don’t like it, simply click the unsubscribe link at the bottom of the email.

Definition of Spam

Spam is unsolicited email sent in bulk. Any promotion, information or solicitation that is sent to a person via e-mail without their prior consent, where there is no pre-existing relationship between the sender and the recipient, is spam.

Examples of Spam

  •  Any e-mail message that is sent to a recipient who had previously signed up to receive newsletters, product information or any other type of bulk email but later opted-out by indicating to the sender that they did not want to receive additional email, then that email is spam.
  •  Any e-mail message that is sent to recipients that have had no prior association with the organization or did not agree to be e-mailed by the organization is spam.
  •  Any e-mail message that is sent to a recipient without a way for a person to opt-out or request that future mailings not be sent to them, is spam.
  •  Any email message that does not have a valid email address in the From Line is spam.
  •  Any email message that contains any false or misleading information in the header, subject line or message itself is spam.
  •  Any email message that promotes an adult web site is spam, unless the recipient has specifically requested information from that web site.
  •  Any message that is sent to e-mail addresses that have been harvested off of web sites, newsgroups, or other areas of the Internet is spam.

    Prohibited Activities:

    •   Spamming: Sending unsolicited and bulk messages, whether commercial or non-commercial, is strictly prohibited.
    •   False Representations: Users must not use false information or misleading subject lines to deceive recipients.
    •   Email Harvesting: Collecting email addresses without consent for the purpose of sending unsolicited messages is not allowed.
    •   Malicious Attachments: Sending emails with malicious attachments, including viruses and malware, is strictly prohibited.
    •   Phishing: Users are prohibited from engaging in phishing activities, attempting to trick recipients into disclosing sensitive information.

    Consent-Based Communication:

    We require users to obtain explicit consent before sending any commercial messages. Consent should be clear, informed, and given voluntarily by the recipient. Additionally, users must provide a detailed and accurate description of the content being delivered.

    Opt-Out Mechanism:

    All commercial communications sent through our platform must include a clear and functional opt-out mechanism. Users who wish to unsubscribe should be able to do so easily. Unsubscribed requests must be honored promptly, and users should not be added back to the mailing list without their explicit consent.

    Data Privacy:

    Users are expected to adhere to data protection laws and regulations. Personal information collected for communication purposes should be handled responsibly and in compliance with relevant privacy policies.

    Penalties for Violation:

    Violation of this anti-spam policy may result in the suspension or termination of the user's account. Legal action may be taken in cases of severe violations. Users are also responsible for any damages caused by their spam activities.
